Terms and Conditions

These Terms and Conditions define the terms of use of this website (hereafter "the Store") by potential visitors or customers. By accessing, browsing and placing an order in the Store, you agree to the terms of use described below. The Store may change this terms and conditions from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes.

These Terms and Conditions apply to all quotes, orders and sales agreements between Solus PRO SRL, VAT RO33639486, with registered address in Baia de Arama nr. 1, bl. B, sc. 3, et. 7, ap. 119, sector 2, Bucuresti and business address in 202 Sos. Oltenitei, Popesti Leordeni, Ilfov, 077160, Romania (hereafter referred to as "the Seller") and the customer. A customer shall mean any natural person or legal entity who places an order for goods or services with the Seller or on whose behalf or for whose account such an order is placed.

The images in the Store are for illustration purposes only and the final product may differ from the images presented.

The product display in the Store does not constitute a legally binding offer. It is only a non-binding online catalogue with the range of products available. By clicking ‘Buy’, the customer makes a legally binding commitment to purchase the goods in the shopping cart. The customer will receive an order confirmation immediately after the order has been submitted. The sales contract will only enter into effect upon receipt of another order confirmation email stating that the order is being processed. Customers can view all of their previous orders by logging into the customer service pages of the Store.

Placing an order

You should follow the technical steps described below in order to place an order in the Store. We also accept Purchase Orders, please send them to us using the form on the Contact page.

  • Add the products to your shopping cart by clicking the "Add to cart" button. Optionally, select the custom options available for selected products before adding the product to the cart.
  • Click on “Go to Checkout” in the shopping cart displayed on the screen.
  • You will be asked to create a new account or use your existing account.
  • You will be asked to enter your Shipping Address or use one of the existing addresses.
  • Select a Shipping Method from the list of available shipping methods.
  • Select a Payment Method from the list of available payment methods. After selecting the payment method, be sure to uncheck the "My billing and shipping address are the same" option if you need to add a different billing address.
  • Add your order comments in the text area available. Use this box to send us any info or special requests for this order.
  • Double-check the Order Summary and if everything is in order, click the "Place Order" button.
  • You will be redirected to the payment processing page.

Payment

Unless otherwise agreed in writing, invoices from the Seller must be paid in full without delay. Orders paid in advance will be shipped upon receipt of payment. For payments by credit card, the actual sum shall be debited when the invoice is issued and the goods are shipped. The total amount shall be reserved on the customer’s credit card as soon as the online order is submitted.

Foreign currency payments shall be credited according to our bank statement. The bank fees must be borne by the customer.

Order acceptance

All orders placed on the Store will be subject to acceptance in accordance with these Terms and Conditions.

The Seller reserves the right to refuse to perform the service promised if it becomes apparent after concluding the contract that the goods are not available although a corresponding contractual transaction has been concluded. In such a case, the customer will be notified immediately. Any considerations which have already been provided will be reimbursed without delay. Further claims against the Seller are excluded.

Non-acceptance of your order may be due to any one or more of the following non-exhaustive reasons:

  • The product you ordered is out of stock.
  • Non-authorisation of payment.
  • We have identified a pricing or product description error.
  • Miss-calculated shipping costs.
  • There is a system or procurement failure.
  • Other restrictions for the country you have selected which prevents fulfilling your order for delivery.

Packaging

All manufactured flight cases are wrapped in clear or black shrink film only. Extra packaging is available on request and may incur additional costs. Please let us know about your extra packaging requests using the order comments box available at the time of placing the order. The seller cannot be held responsible for slight superficial scratches or any similar marks that could nonetheless and exceptionally be inflicted during transport. Indeed, the goods concerned are future "transport material".

Shipping & Delivery

At this moment, we deliver our flight cases to mainland EU (without islands) and mainland UK (without islands). New delivery zones are added constantly, so if your country is not covered yet, we are working on adding it.

All of our orders are dispatched using a courier and can be tracked using a unique consignment number emailed to you at the time of dispatch. The selection of courier is based on size, weight and destination of the order.

The delivery time varies between 1 - 10 working days, depending on the destination country. The delivery time starts after the production or procurement time which is stated for each product in the description page.

Customers are required to check all products and packages before signing for acceptance of the parcel. Should there be any sign of damage to the packaging or the contents, the customer should either refuse the delivery or sign the parcel as "damaged". Any uncertainty should result in the parcel being signed for as "damaged". If the parcel looks acceptable externally, but the customer believes that there may be damage internally, the parcel should be signed for "damaged".

Please check over the parcel while the driver waits. If the driver refuses to wait while you open the parcel, please write "driver refused to wait" on the proof of delivery.

When signing for the parcel on the proof of delivery, you are confirming that the parcel has arrived in an acceptable condition. Any subsequent claim on the basis of the products being damaged will be disregarded by both the courier and the Seller.

Additional customs duties and charges for deliveries to countries outside the EU (third countries) shall be borne by the customer.

Returns

We provide a 14 day return policy for most new, unopened items, starting from the date on which the customer or a third party appointed by the customer, who is not the carrier, takes possession of the final goods delivered. The customer will pay the shipping costs for returning the products, unless the return is a result of our error (the customer received an incorrect or defective item, etc.). Photographic proof must be provided to validate our error.

It is the customer's responsibility to return goods in good condition with all packaging intact. If goods are returned that cannot be resold as "brand new", the customer will only receive a partial refund.

The Seller will reimburse any payments received from the customer, including delivery costs (excluding any additional costs incurred if the customer has selected a different type of delivery to the cheapest standard delivery option offered by the Seller) without delay, but no later than 14 days after the day on which we receive the notice of return from the customer. The Seller will use the same payment method the customer used for the original transaction in order to provide the reimbursement, unless otherwise expressly agreed. We may withhold the reimbursement until we have received the returned goods or until the customer has provided proof that he/she has returned the goods.

No refunds will be accepted for products which are not prefabricated and have been manufactured on the basis of a personal choice or according to customer specifications (custom built flight cases). If the return is the result of our fault, we will cover all the returning costs and have a new case dispatched within an agreed time with the customer.

The Seller can not exchange products. The customer has to return the product and create a new order for the replacement product.

The customer has to notify the Seller about the return by clicking the "Refund" link available in the "My Account" page, under "My Orders" section. All returns must be authorised by the Seller. Failure to gain authorisation will result in a handling fee being incurred.

Warranty

Unless otherwise stated in the product page, all of our flight cases come with 5 years warranty, with the exceptions mentioned below. The warranty covers normal wear and tear and manufacturing defects only. Damage as a result of misuse is not covered under the warranty.

The warranty excludes castors and all internal foam, including inserts.

The Seller reserves the right to request the product to be returned for inspection before warranty is granted.

The warranty does not apply if the usability is restricted by improper use or externally occurring forces (particularly flight or transport damage, e.g. deformation, body breakages, scratches, wear, etc) or by liquids. The transport damage should be reported to the carrier in order to gain compensation from them.

To the extent permitted by law, the Seller liability is limited to the flight case and not the owner's contents. We do not hold responsibility if the contents of the flight case is damaged.

Hardware sold separately comes with a 36 month warranty and plastic flight cases come with a 12 month warranty.

Retention of "Title of goods"

The property of the goods will not pass to any persons or company until all money owed to the Seller have been paid for in full. In the rare cases where payment by instalments is agreed for any particular delivery of goods, title of each of the goods comprised in that delivery will pass to the customer only after the final instalment has been paid in full. Until that time, the customer must bear all risks and shall insure those goods against loss or damage. The customer will be entitled to sell the goods for and on behalf of the account of the Seller and will retain all proceeds of such sale, in trust, for the Seller. The customer hereby assigns to the Seller any future claims against the buyer in the amount of the purchase price agreed between the Seller and the customer, including interest and ancillary payments. The Seller accepts this assignment.

The Seller shall be entitled, at any time, to repossess the goods whether with or without notice and the Seller and its employees or agents shall have the right to enter upon the premises of the customer for the purposes of effecting such repossession.

Content rights for this Store

The Seller holds full rights to the title of the property and thus all copyright and patented rights for the Store. You do not have the right to redistribute, sell, decompile or disassemble any part of the Store.

All information, products or applications contained in this site are the property of the Seller, which reserves the right to modify the content and / or structure of the site at any time and without prior notice.

The entire content of the Store is protected by the Copyright Law, all rights being reserved. All rights relating to the pages, the content and the presentation of the site are owned by the Seller. It is forbidden to copy, modify, display, distribute, transmit, publish, sell, license, create derivative works or use the content of the site for any purpose without the written confirmation from the Seller.

Closing provisions

The Seller is not obliged and is not prepared on principle to participate in a dispute settlement proceeding in front of a consumer arbitration board.

If any of these provisions cannot be applied for whatever reason, this shall not affect the validity of the remaining provisions.
